This Privacy Policy is applicable to everyone who accesses the services on the Moja Platform, owned by BRCK which is hereinafter after referred to as “Moja”, accessible on https://www.mojawifi.com and other interactions with Moja including customer service inquiries, user conference which one may have with Moja.
By using the Moja WiFi Platform, you acknowledge that you have read, understood and agree to the collection and use of your information in line with this policy.
The terms used in this Data and Privacy Policy have the same meanings as in our Terms of Service (TOS) and are considered part of the Terms of Service , unless otherwise defined in this Privacy Policy.

To create an account, you supply Moja with a mobile telephone number, email address or other information such as your gender and date of birth, in order to be able to save your profile for purposes of accumulating and using Moja Points as well as receiving other rewards.
Services Metadata:
When you use the Moja Platform, we collect metadata that helps us understand how you use the services and your preferred content. Moja logs anonymously the content and links you interact with and what Third Party Services you use (if any).
Log data:
As with most websites and technology services delivered over the Internet, our servers automatically collect information when you access the Moja Platform and record it in log files. This log data may include the Internet Protocol (IP) address, the address of the web page visited using the Moja Platform, browser type and settings, the date and time the Services were used, information about browser configuration and plugins, language preferences and cookie data.
Device Information:
Moja collects information about devices accessing the Moja Platform including type of device, what operating system is used, device settings, application IDs, unique device identifiers and crash data. Whether we collect some or all of this Other Information often depends on the type of device used and its settings.
Location Information:
We receive information from you and other third-parties that helps us approximate your location. We may, for example, an IP address received from your browser or device to determine approximate location. Moja may also collect location information from devices in accordance with the consent process provided by your device. Moja may also collect and/or track certain location information that is derived from the preset geographic locations of where our services are available and/or from metadata about adjacent mobile networks.
Moja uses cookies and similar technologies to help us collect other information to help us create an amazing user experience for Moja’s users. You may access our cookie policy here. Other third parties whose services are accessed on our site may similarly use cookies to collect other information. The third parties may be able to associate the information they collect with other information they have about you from other sources. Moja users should check the privacy settings and notices in Third Party services to understand what information and/or data may be disclosed to Moja.
Moja does not receive or store passwords for any Third Party services when users connect to the Third Party services through Moja.
The information that you post to third party applications via the Moja Platform which is intended for public consumption about Moja, including your reviews, tips, photos, check-ins, comments, likes, talk posts, bookmarks, friends, lists, compliments, and account profile may be displayed publicly on the Moja or shared with businesses for insights into the Moja Platform.
In accordance with the consent provided by the users device, any contact information that the user chooses to import is collected when using Moja. Moja may use the contact information provided to communicate to users.
Moja may store information about your use of the Platform, such as search activity, pages viewed, the date and visit times among other information. Moja also may store information that users’ devices provides in connection with the use of the Platform, such access dates and times, pages viewed, browser type and language, type of computer or mobile device, IP address, mobile carrier, unique device identifier, phone number, location, and requested and referring URLs.
Whereas users are under no obligation to provide information, where a user fails to provide some account set up details, they may be unable to enjoy some services on Moja.
USE OF INFORMATION

Moja will use user data in accordance with the user’s instructions, users use of services functionality and as required by law. Moja uses Other Information in furtherance of its legitimate interests in operating its services. More specifically, Moja uses Other Information to:

Moja tries as much as possible to make the Moja Platform as useful as possible for users.
Other Information helps Moja to improve the user experience by helping Moja determina and rank the relevance of content, make suggestions to the user based on historical use and predictive models, track and identify trends and insights as well as help create new products.

Once Information is aggregated or de-identified so it is no longer reasonably associated with an identified or identifiable natural person, Moja may use it for any business purpose.

Moja respects users’ right to privacy as enshrined in the law. To this end, to the extent that any user information is associated with an identified or identifiable natural person it is strictly protected. Moja may need to contact you for account management and similar reasons and will use account data to administer accounts and keep track of point earning and utilisation.

Where necessary, personal information may be used in an investigation where there is a suspected security breach as well as help prevent security issues and abuse to promote the safety and security of Moja users.
To keep Moja users’ information and activity safe. To accomplish this Moja may have to share information and activity of Moja users with relevant authorities on demand subject to applicable law. Upon such request Moja may notify the user.
Moja does not share any personally identifiable information such as name or email address that can be used to contact or identify who you are with any third party.
Service Providers: Some of the services that are offered on Moja, may be provided by third-party service providers. Where Moja has outsourced functions to third-party providers, such as technical and customer support, tracking and reporting functions, quality assurance testing, payment processing functions, and other services. We may share information from or about you with these third-party providers so that they can perform their services or complete your requests. All service providers are subject to a strict data protection and privacy policy to ensure that any shared information is adequately protected and strictly used for the intended purpose.
Aggregate Information: Moja may share user information in the aggregate with third parties, such as advertisers and content distributors. For example, we may disclose the number of users that have been exposed to, or clicked on, advertisements.
Business Transfers: Moja may share information from or about users with subsidiaries, joint ventures, or other companies under common control, in which case we will require them to honor this Privacy Policy. If another company acquires BRCK (which owns Moja) or all or substantially all of its assets, that company will possess the same information, and will assume the rights and obligations with respect to that information as described in this Privacy Policy.
Investigations: We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure is (a) reasonably necessary to comply with legal process and law enforcement instructions and orders, such as a search warrant, summons, statute, judicial proceeding, or other legal process served on us; (b) helpful to prevent, investigate, or identify possible wrongdoing in connection with the Platform; or (c) protect our rights, reputation, property, or that of our users, affiliates, or the public.

Except as set forth herein, Moja does not share users’ personal information with them, and are not responsible for their privacy practices. Users should read and acquaint themselves with the privacy policies on all such third party web Platforms.
Other users may be able to identify you, or associate you with your account if you include personal information in the content you post publicly. You can reduce the risk of being personally identified by using the Platform pseudonymously, though doing so could detract from the credibility of your contributions to the Platform.
If a user chooses to cease using the Platform Moja may retain information about the user for the purposes authorized under this Privacy Policy unless prohibited by law.
AGE REQUIREMENTS
The Platform and its contents are intended for general audiences and persons above the age of 13. Moja does not collect personal information from minors. If you become aware that a minor has provided us with personal information without parental consent, please contact Moja. If Moja becomes aware that a minor has supplied personal information without parental consent, Moja will delete such information and terminate the minor’s account.
Moja follows generally accepted industry standards to protect the personal information submitted to Moja, both during transmission and once received. However, no method of transmission over the Internet or via mobile device, or method of electronic storage, is 100% secure. Therefore, while Moja strives to use commercially acceptable means to protect user’s personal information, we cannot guarantee its absolute security. Moja therefore advises users to take the usual internet safety precautions while using the Moja Platform.
This policy and any dispute or claim arising out of, or related to them, shall be governed by and construed in accordance with the Laws of Kenya without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action or proceeding arising out of, or related to, this policy or the Platform shall be instituted exclusively in courts within the Kenyan jurisdiction.
Moja reserves the right to independently and without notice to change the provisions of this policy.
Should such changes occur, Moja will make sure to announce any major change in a prominent way or notify users by email and of course, this document is public on the Platform, and therefore users will be able to see the changes for any new version. Further, user’s continued use of the Platform following the publishing of updated Terms of Service means that you accept and agree to the changes.
